Don’t fall for the spin. Until the courts rule, this opinion is just that, an opinion of the A.G., not, as he makes clear, “the law.” Furthermore, NY Governor Paterson never issued an executive order. This is now gay history mythology, and no matter how much I try to clarify it, somehow the gay media doesn’t understand (apart from my own paper, Gay City News). Paterson authorized his legal counsel to send a memorandum to state agencies, advising them of the Appellate Division marriage recognition ruling in Martinez v. County of Monroe (2008) and advising them to comply with it, but the governor did NOT issue a formal executive order. Gansler points this out in his Opinion.
